Do you have a relevant will?

Your last will and testament is one of your most valuable documents.

At Securitas we can assist you in drafting a will that considers the following aspects – who inherits your assets upon your death, an appointed executor, and should it apply – trustees and guardians for your minor children. It is important to keep in mind that the Master of the High Court doesn’t appoint a private person to administrate the estate.

If your estate has a value of more than R250 000 the will insists that the Executor appoints an agent to assist them in the process of selling and distributing the estate. Therefore, it is vital that your estate is properly drafted by an organisation that can manage the process from beginning to end.

 

When is the right time to draw up a will?

You can start as early as 16 years to draft your will if you have the legal capacity at the making of the will and should you comply with all the legislative requirements. Should you not comply, the Master of the Supreme Court cannot accept the will when submitted upon your death.

Should you pass away without a will, you will die intestate which means that the distribution of your assets will be distributed according to the Intestate Succession Act. This could result in your assets being distributed to people you did not intend to inherit it.

 

When was the last time you reviewed your will?

You should revise your will when a life-changing event takes place i.e. marriage, the birth of a child, divorce, death of your spouse or death of the appointed Executor. Did you know that if you don’t update you will three months after your divorce, your ex-spouse will still be entitled to inherit?

 

Are your parents’ wills in order?

If not, please let us assist you in the process of updating their will. Should one of them pass away without a relevant will, the children will not only have to deal with the loss of a parent but also unnecessary administrative loose ends.
